Silent Auction 2025 Terms & Conditions

For Our Lady Star of the Sea, Marblehead, MA. By registering and/or placing a bid in this Auction, you agree to the following Terms & Conditions:

1. Binding Agreement
All bids are legally binding offers. The Winning Bidder must complete payment in full within 72 hours of the Auction closing (unless otherwise stated).

2. Payment Requirements
Payment may be made only by methods approved by the Organization.
Full payment must be received before any item is released.
All sales are final. No refunds or exchanges.
If a Winning Bidder fails to pay within the stated timeframe, the Organization may:
Offer the item to the next highest bidder, or
Treat the item as a donation and retain it for resale or reuse.

3. Item Pickup / Delivery / Transfer of Responsibility
Winning Bidders must pick up items at the time/location specified by the Organization, unless alternative arrangements are confirmed in writing.
Items not picked up within 14 days may be considered forfeited without refund.
Risk of damage, loss, or theft transfers to the Winning Bidder upon pickup or shipment.

4. Item Condition / Donor Fulfillment
All items are offered “AS IS, WHERE IS,” without warranties or guarantees of any kind.
Any values listed (including Fair Market Value) are good-faith estimates provided for tax and reference purposes only.
Some items (experiences, tickets, memberships) may include blackout dates, expiration dates, and restrictions. It is the bidder’s responsibility to review and comply.
If a donor fails to deliver the item as described, the Organization’s liability is limited to refunding the Winning Amount.

5. Eligibility & Conduct
The Organization reserves the right to:
Reject any bid or bidder
Remove or modify items before auction close
Resolve bid disputes in its sole discretion

6. Taxes
Where applicable, Massachusetts sales tax will be collected in accordance with state law. Bidders are solely responsible for any personal tax reporting or deduction questions — consult a tax professional.

7. Hold Harmless / Release of Liability
By participating in the Auction you agree to release, indemnify, and hold harmless the Organization, its staff, volunteers, directors, and donors from any and all liability, claims, injuries, losses, or damages arising out of:
Bidding in the Auction
Possession, use, or enjoyment of any item
Attendance at any donated event or experience
To the fullest extent permitted by Massachusetts law, the Organization’s maximum liability is limited to the amount paid for the item.

8. Governing Law
These Terms shall be governed by the laws of the Commonwealth of Massachusetts.
Any dispute shall be brought exclusively in a court of competent jurisdiction located in Essex County, Massachusetts.

9. Acceptance
Placing a bid constitutes:
Acceptance of these Terms & Conditions
Certification that the bidder is at least 18 years of age
Consent to be contacted regarding payment and pickup.

Every Weekday (Monday—Saturday) at 9:00am

Our Lady Star of the Sea Church is open 7 days a week 7:00 A.M. to 7:00 P.M. for individual devotion (Prayer, Adoration, Stations of the Cross, and the Rosary).
